Why consider utilising your Waqf for charitable purposes?
When you create your Waqf Fund you should always consider what the long-term benefit will be for you not just in this world but also in the Hereafter. By setting out from the beginning with an intention of benefitting charitable causes with your Waqf, even if circumstances dictate that this will only be after your immediate family have had access to the income for their needs, you ensure that your Waqf is setup to provide an ever increasing benefit for you long after your passing.

Waqf is the best means by which to provide for sadaqah jaariyah (ongoing charity) because it is structured in a way that allows the maintenance and growth of the charitable funding over time. This can lead to a potential exponential benefit to you the donor.

When considering the options for how you will want to utilise your Waqf Fund to benefit charity and charitable causes there are essentially three options open to you. It is also possible to move from Option 1 to Options 2 and 3 at some later date.

Utilise your Will Trust
After your passing, your Waqf assets will pass into your Islamic Will trust. They will be held separately from other non-Waqf assets and can continue to be utilised for your family as well as charitable projects and causes you have chosen. This option provides the most flexibility but the least in terms of tax savings.

- Full control of the assets
- Can continue to utilise assets for own family
- Choose exactly which projects and causes to benefit
Cons:
- Requires effective trustees to manage into the future
- No inheritance tax savings
- Value of fund may be decreased due to inheritance tax payments

Create your own charity
Pros:
- Retain control over assets (subject to charity law and guidelines)
- Able to choose exactly which projects and causes to benefit
- Obtain large potential tax savings on estate
Cons:
- Subject to Charity Commission regulation and administrative burden
- Reduced potential effectiveness as compared to well-run established Waqf charity
- Family can no longer benefit from assets

Donate to existing Waqf charity
For many the existence and continued strong growth in the Waqf charity sector will allow them to locate the perfect charity partner or partners with whom to earmark assets to transfer to after their passing. This option ensures assets pass to specialist Waqf charities, capable of managing large portfolios of assets and hence extracting the maximum possible return on the investment. It also means the potential for significant inheritance tax savings. However, control over the assets is likely to be reduced.

- Easiest and simplest option to obtain maximum charitable reward
- Obtain large potential tax savings on estate
- Benefits and efficiencies of scale mean greatest likely return
Cons:
- Lose control of assets and decision-making
- Unlikely to have full-control of destination and usage of funds.
- Family can no longer benefit from assets

The beauty of Waqf is that it is so flexible that it allows this change of mind over time. You can continue to develop your plans during your lifetime, and leave instructions for how your trustees should deal with matters or what factors they should be considering before deciding on a course of action, after your death.

For Charities
iWaqf - Changing the face of charitable giving
Waqf has never taken off to date as a means of charitable funding because the approach of charities has always been limited to the ‘ask for funds upfront’ model. This (1) reduces the amount that potential donors consider giving, and (2) means that they can no longer benefit in anyway from their funds.
iWaqf’s approach is different. By setting up personal Waqf Funds, each donor retains control over their assets, allowing them to (1) create a Waqf for much greater proportions of their estates, and (2) retain far more flexibility in utilising their resources.
This opens up opportunities for Waqf charities because they are now able to act as trusted partners. In the short-term, as more and more individuals create their own Waqf Funds this will grow the recognition and understanding of Waqf throughout the Muslim community, bringing much needed exposure for Waqf charities.
In the medium-term, Waqf charities can expect more regular donations of income from individuals who have created their own Waqf Funds and who recognise the importance of utilising the funds for the benefit of Waqf charitable causes.
In the long-term, successful Waqf charities which have a proven track record will see large donations from individuals and trustees of personal Waqf Funds, leading to much faster growth then could otherwise be expected.
